III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear represented the <br />operator during the field inspection and the records check. Mining has just started in the third longwall panel of <br />the B-seam in the west district. <br />Main Mine Site <br />At the utilities bench, [he back ditch was functional. The west side seep was a little wet but there was no ponded <br />or flowing seep water. The bench outside berm was in place. There were no boulders behind the rock catchment <br />berm above the utility bench. The rock catchment berm did not show any signs of slumping or moving. The <br />shaft site above and directly behind the utilities bench was stable, although the cut slope above the pad needs to <br />be revegetated. The topsoil stockpile on the utility bench was vegetated and the topsoil sign was up. There had <br />been a slide in the fill outslope of this bench. The operator reworked the area and time will tell if it remains <br />stable. The road up to the utility bench was in good condition. <br />Not a lot of coal was being stockpiled on the D-seam portal bench. The back ditches and culverts were clear. <br />There are a couple of rocks very close to the inlet of the culvert that goes underneath the bench and these rocks <br />should be removed while the coal stockpile is down in size. The outlet of the culvert underneath the road to the <br />lower parking lot could use some cleaning soon. There were no problems at the material storage areas at this <br />site. Also, the cap and powder houses were properly locked. There were no leaks at the fuel facility. The cut and <br />fill slopes of this bench and the other benches appeared to be stable. <br />The cut and fill slopes of the B-seam portal bench were stable. The upland diversion ditch was in place. The <br />operator was rebuilding a short section of haul road between the B-seam portal bench and the excess material <br />storage area. The culverts and ditches in this area were functioning well. The top of the excess material storage <br />area had a moderate amount of vegetative cover. There were no stability problems with the storage pile. <br />The main topsoil stockpile was well vegetated. Thistle had been recently sprayed. Collection and diversion <br />ditches and berms were in place. Topsoil signs were up. <br />There was a small amount ofcoa( on the lower coal stockpile bench. There were no apparent problems with <br />fugitive dust in the air or tracked onto the highway. The sediment control ditches, culverts and straw bales were <br />functioning properly. No problems were observed with the wash plant and synfuels plant. The sediment control <br />ditches and culverts were functional, although one culvert between the wash plant and the substation will need <br />cleaning soon. The cut slope behind the wash plant bench was stable. Coal refuse was being loaded next to the <br />wash plant and trucked to gob pile no. 2. Pond B had a small amount of water in it. More water was coming in <br />from washdown. The operator began cleanout work on the pond but had to stop. The work will resume a little <br />later. The pond embankment was stable and the float was on the primary discharge hose. The gated primary <br />valve was in the closed position. <br />The mine ID sign was up at the entrance and contained the correct information. Surface disturbance markers <br />were up around the disturbed area as well. <br />
