III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Munger Canyon Mine, focusing solely on theLoma Loadout. The <br />Loadout was inspected at 10:20 am, with no operator contact present. Soils at the site were moist from <br />recent precipitation. The required LD. signs were posted, and sediment containmentbenn and silt fence <br />sediment trap were intact and functional. Straw mulch from last fall's seeding was in place. Success of <br />initial grass establishment will be assessed later this yeaz. In general the site was in good condition with no <br />probtems apparent. <br />The mine bench site in Munger Canyon was not visited, as it was apparent that the steep access road to the <br />bench would have been extremely muddy in spots, with snow cover still present at the bench azea, on the <br />north facing canyon slope. <br />The operator is reminded that abatement of NOV CV-2001-018 is to be completedon or before March 21, <br />2002. Failure to complete the abatement by the deadline will result in issuance of a `Failure to Abate <br />Cessation Order" by the Division. Abatement requees the operator to spread non-toxic cover soil over <br />the waste coal material at the Munger bench, and revegetate the site with the approved stabilization <br />seedmix. The abatement deadline can be extended only by the Division Dvector, and only based upon <br />written request and showing of good cause pursuant to one of the criteria specified in Rule 5.03.2(c)(!) <br />through (v). <br />
