III. COMMENTS -COMPLIANCE <br />Bear C-81-033 <br />Pg 1 /1 13 Sept 04 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Bear No. 3 Mine conducted by Jim Stark of CDMG. <br />The mine is reclaimed and in the period of extended liability. The weather was warm <br />and sunny and the ground was dry. <br />Signs and Markers: The mine ID sign was in place and contained all of the necessary <br />information at the time of the inspection. <br />Roads: -The entrance road to the mine is a paved road. The road was well <br />maintained and in good condition. <br />-The bridge across the Gunnison River was in good shape at the time of the <br />inspection. <br />Hydrologic Balance: -The sediment pond was dry at the time of the inspection. The <br />embankment was well vegetated and appeared to be stable. There were no <br />erosional problems noted on the embankment at the time of the inspection. The <br />emergency spillway was a riprapped channel that appeared to be stable. <br />-The treatment pond contained water and was discharging into the Gunnison River <br />at the time of the inspection. The discharge is orange-brown in color but meets <br />water quality parameters. The pond embankment was well vegetated and <br />appeared to be stable at the time of the inspection. There were no erosional <br />features noted on the embankment at the time of the inspection. <br />-The Edwards Mine portal spring was discharging at the time of the inspection. The <br />ground around the spring discharge was saturated. The water discharging was warm <br />and orange-brown in color. The discharge was sampled for various orggnic and <br />inorganic constituents but the Division has not yet received the results from the lab. <br />Revegetation/Reclamation Success: The vegetative cover appears to be adequate <br />to control erosion. There is some thistle around the site that should be sprayed. <br />
