• (Page 31 • <br />MINE ID # OR PROSPECTING ID # M-79-181 <br />INSPECTION DATE 7/20/99 INSPECTOR'S INITIALS J(J(}~ <br />Unpermitted Facilities An intact crusher was enclosed in a building, located at the mouth of one of the <br />portals. Auger feed lines extended from the crusher to an underground location behind a locked door. <br />Additional milling and separating equipment were observed on the upper-most access road. DMG records do <br />not indicate that the operation is approved for on-site processing, milling or tailings disposal. DMG identified <br />the unpermitted facilities as a problem during the 8/28/97 inspection. Corrective action from the 8/28/97 <br />inspection required that the operator either remove all equipment, materials, chemicals and solution tanks <br />associated with the unpermitted milling operation; OR submit a new permit application to allow on-site <br />processing and milling. Some of the unpermitted equipment observed during the 8/28/97 inspection had <br />apparently been removed. Equipment for carbon-in-leach cyanidation circuit, unprotected barrels of Sodium <br />Hypochlorite and scattered carbon particles, present during the 8/28/97 inspection, were not observed during <br />this inspection. However, additional unpermitted processing equipment remains intact and the operator has <br />not submitted a new permit application to include on-site processing. <br />Note: DMG records indicate that the unpermitted milling operation has existed since 1985. <br />Upon discovering the unpermitted milling operation in 1985, DMG encouraged the <br />operator to amend the existing permit to include on-site processing. DMG records do not <br />indicate that the operator has ever amended the permit to include milling and tailings <br />disposal but apparently refuses to completely dismantle and remove the facility. <br />Permit documentation states that fuels will not be stored on site. However, the three fuel storage tanks, <br />identified during the 8/28/97 inspection remained on-site. Fuel storage tanks appeared to be empty. Spill <br />containment berm for the fuel tanks was absent. <br />Temporary Cessation DMG records indicate that mining operations may have remained inactive and in <br />Temporary Cessation status for 10 years. However, DMG records do not indicate receipt of the Notice of <br />Temporary Cessation, required from the operator by Rule 1.13.5. Additionally, DMG records do not indicate <br />receipt of the request for extension to the initial 5 year period of Temporary Cessation, as required by Rule <br />1.13.8. Rule 1.13.9 states that in no case shall Temporary Cessation be continued for more than 10 years <br />without terminating the mining operation and fully complying with the reclamation plan, Act and Rules.
