Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are Identified below. <br />Hydrologic Balance (4.05) <br />1. All ditches and both sediment ponds were clean and functional at the <br />time of the inspection. The steep south exposures in the portal face-up <br />area were dry. A partial snow cover existed on the primarily west-facing <br />slopes below the portals. <br />Topsoil (4.06) <br />1. Both the topsoil and subsoil stockpiles at the site were inspected. <br />It is interesting to note that a good stabilizing stand of perennial <br />grass (primarily crested wheatgrass) has been established on the subsoil <br />pile, while the topsoil pile appears to be dominated by cheatgrass. This <br />is probably attributable to the fact that cheatgrass was prevalent 1n the <br />vegetation community prior to disturbance, and an abundance of seed was <br />present in the topsoil. Control of cheatgrass on topsoil piles, as well <br />as final reclamation, should be a conslderatlon in future operations at <br />the site. <br />Revegetation (4.15) <br />1. A good stand of crested wheatgrass has been established on the <br />west-facing slope of the old Farmer's Mine, below the portal bench. No <br />vegetation has been established on the road cuts and fills in the Nancos <br />shale leading up to the portal bench. [f successful vegetation <br />establishment is to be achieved at Fruita, particular conslderatlon will <br />have to be given to providing substrate and slope conditions conducive to <br />moisture retention and plant growth. Road cuts in the Mancos should be <br />gentle enough to allow for topsoiling, or alternative stabilization <br />techniques will be required to provide for surface stabilization. <br />Control of cheatgrass will also be essential to allow for establishment <br />of the slower developing perennials, particularly the warm season species <br />which will be used 1n final reclamation. <br />
