For each standard marked (4), explain why it is unknown <br />whether or not the State has failed to take appropriate <br />action. <br />The company claims that the operation is faced with disposing of excess <br />spoil which has been deposited in a partially constructed, permanent <br />fill designated the east dump. The MLRD contends that excess spoil <br />conditions do not in fact, exist, and that construction of the east dump <br />~is improper because excess spoil conditions were not indicated or __ <br />addressed in the current permit. The final decision as to what course <br />to follow may eventually rest with the Colorado Mined Land Reclamation <br />Board. <br /> <br />
