III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on June 23, 2005 by Mike Boulay of <br />the DMG. Dan Allen of Seneca Coal Company was present during the entire inspection. <br />Weather conditions were cloudy and cool. Ground conditions throughout the mine site were <br />damp due to heavy rain the day prior to this inspection. The dragline was operating in the <br />northern portion of the Wolf Creek Pit, and coal was being loaded and hauled from the south <br />Wolf Creek Pit area. Haul roads were in good condition throughout the site. The roads were <br />damp but well maintained. A grader was working on the active haul from the Wolf Creek Pit. <br />Hvdroloeic Balance <br />Sedimentation Ponds 010, 012, 013, and 014 were viewed. Pond 010 was full and dischazging <br />clear water. Pond 012 was viewed from the haul road near the south Valora Pit; the pond was <br />retaining water but did not appear to be discharging. Ponds 013 and 014 were viewed from the <br />Scraper Pit; both ponds were retaining water but not dischazging. Pond embankments were <br />stable and no problems were noted at any of these sedimentation ponds. <br />A significant amount of water has collected in the low point of the Scraper Pit between Ponds <br />013 and 014. SCC has indicated that the pit water will be pumped to either or both Ponds 013 <br />and 014 for treatment. <br />Backfill and Gradine <br />Two dozers were working to push spoil back into the Scraper Pit. SCC does not plan to remove <br />any more coal from the Scraper Pit location. One dozer was backfilling spoil into the South <br />Valora Pit. Good progress has been made in backfilling the South Valora Pit. <br />Slides and Dama¢e <br />The slide area below the former Haul Road D embankment above Pond 012 was viewed. The <br />slide damaged azea is becoming well vegetated. No significant additional movement has <br />occurred below the former haul road embankment since the area was last inspected. <br />The slide that occurred in the South Valora Pit at the top of the highwall has been shored and <br />stabilized by backfilling with spoil up to the base of the slide area. The mitigation measures <br />taken since the last inspection have stabilized the slide azea. <br />
