PUBLIC NOTICE <br />The Colorado Division of Reclamation Mining and Safety proposes to reduce the <br />inspection frequency of the Amess-McGriffin Mine (File No. C-1981-042) from a <br />minimum of 12 inspections per year to one complete and three partial inspections per <br />year. The Arness-McGriffin Mine is an expired mine permit site located in La Plata <br />County, approximately 4.5 miles west of the town of Durango, CO. The permit was held <br />by Arness and McGriffin Coal Company. The approximate legal description of the mine <br />site is SW'/< Section 16, T35N, R10W, of the New Mexico Principal Meridian. The total <br />permit acreage encompasses 40 acres, with approximately 5 acres disturbed. The site has <br />been reclaimed since 1990 with some additional reclamation work since that time. None <br />of the original $13,750 of forfeited bond monies remains. <br />The Division is proposing to reduce the inspection frequency because the site has been <br />largely reclaimed and poses no imminent threats to public health and safety or significant <br />environmental harm to land, air, or water resources. Site conditions generally change <br />very little from month to month. The Division proposes one complete and three partial <br />inspections each year, conducted quarterly. This inspection frequency will be sufficient <br />for monitoring success of vegetation establishment, weed control, and for identifying <br />developing problems which may require maintenance. <br />This decision is based on a complete inspection and written findings as required by Rule <br />5.02.2(8)(a) of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, <br />et seq., C.R.S., and the regulations promulgated thereunder. Copies of the written <br />findings are on file for public inspection at the Colorado Division of Reclamation, <br />Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, <br />Colorado, 80203, telephone (303) 866-3567, and at the La Plata County Clerk and <br />Recorder's Office at 1060 E. Second Avenue, Durango, Colorado. Persons with an <br />interest that may be adversely affected by the proposed reduced inspection frequency <br />may submit written comments to the Colorado Division of Reclamation, Mining and <br />Safety, within thirty (30) days of this notice. <br />
