III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Roads <br />The paved main haul road was in excellent condition, as was the graveled haul road to the gob pile. The silt <br />fence at the base of the gob pile haul road fill will need repair fairly soon. The access road that leads from the D- <br />seam portal bench up to the water tank bench was also in good condition. Guard rail and road berms were in <br />place and were functional. <br />Sins and Markers <br />Mine ID signs were present and contained the correct information. Bowie Resources Limited has submitted a <br />succession of operator application so, when it is approved, the mine ID signs will need to be changed to reflect <br />the name of the new operator, Bowie Resources LLC. Surface disturbance mazkers were up at the mine site. <br />Topsoil <br />At the main mine site topsoil stockpile, a small amount of recently-placed topsoil spilled over the protective <br />berm. This topsoil needs to be pulled back before runoff carries the topsoil away. The straw bales at the gob pile <br />topsoil stockpile will need to be replaced soon. <br />At the unit train loadout topsoil stockpile, the north end of the pile lies on the property of a private landowner. <br />Bowie has the legal right to use this property. However, the landowner wants to graze horses on his land. Before <br />grazing begins, Bowie needs to install fencing so that the horses won't graze on the topsoil stockpile. <br />Gob Pile <br />There was positive drainage on the top of the gob pile. The gravel underdrain was exposed at the back of the gob <br />pile. Collection and diversion ditches were functional. The straw bales at the base of the gob pile will need <br />replacing in the neaz future. <br />Hydroloev ' <br />The water level in Pond C was up to the top of the primary dischazge tube. The gated valve was closed. The <br />same was true with Pond ~. Pond B needs cleaning very soon. Also, the silt fence at the base of the Pond B <br />embankment needs repair in a couple of spots. At Pond D the water level was about 6 inches below the bottom <br />ofihe primary discharge tube. Ponds J and K were dry and their gated primary discharge tubes were closed. <br />Pond embankmentsappeazed to be stable and spillways were functional. <br />Culverts and ditches around the mine site were functional. However, two culverts at the back of the D-seam <br />portal bench, culverts C-C4 and C-C 13, need cleaning at their inlets. <br />Records <br />The records were in compliance, as documented in the attached records checklist <br />c:/word/bowie2/insp0304 <br />2 <br />
