III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham and Jim Stark of the Colorado <br />Division of Minerals and Geology (DMG). The weather was warm and ground conditions <br />were generally dry with some muddy areas due to recent episodes weeks of rain and snow. <br />Areas were accessible by foot and vehicle. George Patterson of Energy Fuels Coal Inc. met <br />us at the site and accompanied us on the inspection of the reclaimed portal area. <br />Roads <br />The mine access road was found in good condition, considering the recent wet and muddy <br />weather. The road to the refuse disposal area was slightly rutted due to traffic during wet <br />weather but was not ponding water or showing signs of excessive erosion. <br />Hydrologic Balance <br />Pond 5 was holding some water but did not appear to have discharged. Runoff from the <br />reclaimed area meets the access road ditch prior to entering the pond inlet. A small gully <br />has started to develop due to abundant moisture and subsequent runoff. This gully should <br />be monitored over the growing season for signs of enlarging. As vegetation becomes <br />established, a reduction in runoff would be expected. The yard areas SAE appeared normal <br />and in good condition. Magpie Creek diversion appeared to pass recent flows without <br />incident. Rock check dams performed well and appeared normal. <br />Pond 4 was holding a moderate amount of water. The embankment and spillways appeared <br />normal and in good condition. <br />Processing Waste <br />Forest Service personnel were on the surface of the refuse pile planting shrubs in small <br />groupings as required by the approved permit. This work will be inspected in more detail this <br />field season. The outslopes and recently reclaimed areas of the RDA showed no sign of <br />slumps, debris flows, or slides due to the abundant moisture. Diversion ditches appeared <br />normal and functional. Evidence of heavy runoff was not observed. <br />Revegetation <br />Due to excellent spring moisture and warming conditions, sprouting has begun on the <br />reclaimed portal area. Species could not be identified, as the plants were very small. <br />However, sprouts were noted every 8-12 inches nearly everywhere on the reclamation. <br />Overall, areas inspected appeared in excellent condition for the spring season. <br />3 <br />
