III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments Include discussion.of observations made <br />during the inspection: Comments also describe any enforcement actions-taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the inspection. <br />Roads <br />The paved haul road was in very good condition, as was the graveled road on the east side of the loadout. The <br />light use road along the railroad tracks was wet in spots but was passable. The east side gate was open. <br />Topsoil Stockpiles <br />The operator has covered the south-facing slope of the west topsoil stockpile with matting to encourage <br />vegetative growth. This area has been a problem in the past. 'The remaining portions of the stockpile were well <br />vegetated. The vegetative cover on the east topsoil stockpile was moderate. Topsoil signs were up on both <br />stockpiles. The collection and diversion ditches at both sites were functional. <br />Hydrology <br />All of the culverts and ditches at the loadout were functional. However, the outlet of the culvert at the entrance <br />to the shop parking lot will need maintenance soon. The straw bales and silt fence along the railroad tracks aze <br />in place and are functional. <br />The water level in the-east pond was about one foot below the primary gate invert. The gated valve was closed. <br />The pond embankment was well vegetated and pond inslopes and outslopes were stable. The west dugout pond <br />was dry. The silt fence in the spillway was in place. Vegetative cover was poor. <br />Siens and Markers <br />The operator has installed more permit boundary marker signs that clearly mark the boundary. Mine ID signs <br />were up at the west entrance, the east entrance and neaz the railroad tracks crossing. <br />Facilities <br />During the inspection, railcars and coal haul trucks were being loaded. There was localized coal dust but none <br />went offsite. There were no problems with any of the facilities. <br />Records ' <br />The records were in compliance.
