III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by DMG staff from the Durango Office, <br />701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. Operations were active <br />during the time of the inspection; however, no contact with mine personal occurred. The mine office <br />was locked. <br />Large sediment pond was holding water, approximately 4.5 feet deep. Water level was well below the <br />inlet for the primary spillway, no discharge was noted. Secondary spillway appeared intact and <br />capable of functioning as designed. Pond embankment appeared stable, evidence of slumping, <br />settling or erosion was not observed. <br />Small sediment pond was holding water, approximately 2 feet deep. Water level was well below the <br />inlet of the primary spillway, no discharge noted. Secondary spillway appeared intact and capable of <br />functioning as designed.
