III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the North Thompson Creek Mine, conducted by Tom Kaldenbach. <br />No one else was present. The ground was dry. <br />The Division's review of bond release application SL-06 is in progress. SL-06 is an application for <br />final bond release of the entire permit azea. One of objective of this inspection was to verify that repair <br />work has been completed on sinkholes in the refuse pile and collapsed backfill at the Mine No. 3 <br />portal. Recent reclamation of the two piezometers at the base of the refuse pile was also to be verified. <br />These items were noted as needing completion during the bond release inspection held April 17, 2007. <br />Photographs taken during the inspection are provided at the end of this report. <br />Availability of Records <br />All required records, with the exception of a valid liability insurance certificate and DRMS inspection <br />reports for April and June, 2007, were on file at the Garfield County Courthouse in Glenwood Springs <br />(see attached list). <br />Siens and Markers <br />Disturbed area boundary markers (steel stakes) were properly displayed at the numerous locations <br />inspected. Mine i.d. signs (including the DBMS address and phone number) were properly displayed <br />on the public road entrances into the permit area. No topsoil markers are required as all topsoil <br />replacement has been completed. <br />Roads <br />The only remaining roads in the permit area, other than County and Forest Service roads, aze the two- <br />track light use road that extends through the Water Development (treatment) azea and the former haul <br />road that extends through the former loadout portion of the permit azea. The two-track and haul road <br />have been approved as permanent features to remain after final bond release. <br />Hydroloeic Balance <br />Pond 9 -The sediment control pond (pond 9) was dry. The embankments of this pond appeared stable, <br />with a fair amount of vegetative cover. The principal spillway (a 12-inch diameter steel pipe) and the <br />emergency spillway (a rock rip-rapped channel) appeazed in good condition. This pond has previously <br />been approved as a permanent feature on the site for use by livestock and wildlife. <br />Mine water discharge and treatment. Water from Mine No. 3 was dischazging at an estimated rate of <br />5 gpm into Long Pond from the pvc pipe at the west end of the pond. The pipe from Mine No. 1 was <br />not dischazging. The three treatment ponds are part of the 4.3-acre Developed Water Area that has <br />been approved as a permanent part of the site. The ponds were at operational capacity and appeazed to <br />be functioning properly. <br />
