The access road leaves the main <br />highway between Bowie and Somerset in the North Fork of the Gunnison River <br />mining area. <br />This is an underground coal mine. It is presently operating on fee coal <br />under State Permit 76-6. There was a mining plan submitted on May 21, 1979 <br />for approval to mine federal coal, but it has not yet been reviewed. Colorado <br />Lease, C-033301, has been subleased by Sunflower Energy from U.S. Steel Corp. <br />The lease and approved assignment documents were reviewed and found to be in <br />order. The surface area where the mine facilities are located is private <br />land and the surface over the mine is Forest Service owned. <br />COMPLIANCE WITH INTERIM REGULATIONS <br />717.11 General Obligations <br />A copy of the recently submitted mining plan was reviewed at the mine <br />site. Copies of permits for fugitive dust, local government approval <br />and state approval were adequate. No NPDES permit was available at <br />the site but a letter showing that the permit was in the process of <br />being amended at the Colorado Water Quality Control Division was <br />available. No water is presently discharging so a Notice of Violation <br />was not given. The operator was advised that a copy of the NPDES <br />permit must be at or near the mine site when water discharge begins. <br />Discharge of water from the mine or the disturbed area will not begin <br />until the drainage system is completed. <br />
