The access road leaves the main highway between Bowie and Somerset in the North Fork of the Gunnison River mining area. This is an underground coal mine. It is presently operating on fee coal under State Permit 76-6. There was a mining plan submitted on May 21, 1979 for approval to mine federal coal, but it has not yet been reviewed. Colorado Lease, C-033301, has been subleased by Sunflower Energy from U.S. Steel Corp. The lease and approved assignment documents were reviewed and found to be in order. The surface area where the mine facilities are located is private land and the surface over the mine is Forest Service owned. COMPLIANCE WITH INTERIM REGULATIONS 717.11 General Obligations A copy of the recently submitted mining plan was reviewed at the mine site. Copies of permits for fugitive dust, local government approval and state approval were adequate. No NPDES permit was available at the site but a letter showing that the permit was in the process of being amended at the Colorado Water Quality Control Division was available. No water is presently discharging so a Notice of Violation was not given. The operator was advised that a copy of the NPDES permit must be at or near the mine site when water discharge begins. Discharge of water from the mine or the disturbed area will not begin until the drainage system is completed.
