III. Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules and <br />Regulations, and the permit also are identified below. <br />Hydrologic Balance (4.05 <br />The operator had reported a problem with hydrogen sulfide smell in the <br />alluvial wells. The wells had been uncapped in order to prevent accumulation <br />of gas. The gas may be originating from coal seams in the area, or may be <br />related to oil and gas drilling activity immediately upstream in Mann Draw. <br />Samples were drawn from the wells and submitted for analysis. The operator <br />and the Division are awaiting results. <br />Ponds A and B were discharging. Samples had been taken from both. The <br />primary discharge culvert from Pond A has a tear at the junction with the <br />light use road allowing road runoff to mix with pond discharge. This should <br />be repaired so as not to contaminate pond discharge samples. <br />The stand pipe in Pond B has a seepage leak at the seam below the dewatering <br />hole. This should be repaired as soon as the pond level declines. <br />Mann Draw was noted to be flowing during the inspection. <br />
