III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one <br />represented the operator during the field inspection. <br />Reclamation <br />The contractor continues backfilling operations at the West Portal. There has not been much <br />earthmoving since the last Division inspection. The contractor has begun using dump trucks to <br />haul backfill material from the bottom of the slope to a point half way up the slope. The <br />contractor cut a path through the main topsoil stockpile as part of the haul route. The topsoil had <br />been graded to the side for the road cut. Caze must be taken not to compact the topsoil. It would <br />also be a good idea to put up a couple more topsoil signs to make sure that topsoil isn't graded <br />into the backfill. <br />Now that the earthwork excavation is approaching the southern edge of the West Portal bench, <br />the silt fence at the bottom of the south-facing slope needs extension in both directions further up <br />the side slopes. The silt fence on the north-facing slope that protects the culvert inlet is <br />functional. It would be a good idea to install some silt fence between the temporazy topsoil pile <br />near the pond and the pond's riprapped spillway outlet. Also, there is some thistle that is <br />beginning to grow on the east-facing slope of this temporary topsoil pile. This thistle should be <br />removed before it goes to seed and contaminates the topsoil. <br />At the West Portal fan site, the contractor has placed additional coal waste on top of the vent <br />shaft fill to allow for settling. The topsoil stockpile sign needs to be put back up and one stake of <br />the silt fence needs to be repaired. The rest of the silt fence is in good condition. There was no <br />erosional gullying at the topsoil stockpile. <br />The structural demolition at the east mine is progressing smoothly. The office bathhouse has <br />been completely dismantled. The portals have been backfilled. The 2000 ton coal bin on the shop <br />bench is being dismantled now. There is a considerable amount of equipment being stored <br />temporarily on the crusher/screener bench, for shipment. <br />The temporazy reclamation of the highway coal stockpile azea has not been finished due to a <br />broken dozer. However, most of the azea has been covered by soil material and the site is looking <br />very good. The pond has been recently cleaned out. Once grading is complete, the area will be <br />seeded. <br />
