III. COMMENTS - COMPLL~NCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence suooortine the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Reclamation, Mining and <br />Safety. Jim Kiger represented the Terror Creek Company during the field inspection and records check. <br />Roads <br />The main paved haul road was in very good condition. There were no problems with the guard rail. The <br />graveled east entrance road was also in good shape. The light use road along [he tracks was passable. <br />Siuns and Markers <br />The mine ID sign was up at the entrance and had the correct information. There was a mine ID sign up at the <br />east entrance as well. The operator is in the process of updating this sign with the correct street address, which <br />had recently changed. Permit boundary markers were un around the site. <br />H dy rology <br />The sediment control system was functioning properly at the loadout. The ditches had adequate capacity. The <br />culverts also had capacity, although two culverts needed minor maintenance. The inlet of the culvert at the top <br />of the hill needed a little cleaning. The operator was able to clean it out immediately. The inlet of the culvert at <br />the base of the haul road had a little debris in it. <br />The east sediment pond water level was two feet below discharge, although the gated primary pipe valve was <br />closed. The pond embankment was well vegetated and appeared to be stable. The west dugout pond was dry, <br />with the spillway operational. <br />The silt fence and straw bales were in place along the railroad track small area exemption. <br />Topsoil <br />The east topsoil stockpile had a moderate vegetative cover. The topsoil signs were up. The collection and <br />diversion ditches were well vegetated and had sufficient capacity. The west topsoil stockpile had a good <br />vegetative cover and its topsoil signs were up as well. The collection/diversion berm was in place. <br />Facilities <br />There were no indications of fugitive dust ofFsite. There were no coal fines on the highway at the loadout's main <br />entrance. There were no coal haul trucks unloading and no railroad cars being loaded during the inspection. No <br />fuel leaks were seen at the fuel facility. No problems were observed at the mine office and shop area, substation, <br />material storage area and the loading area. <br />Records <br />The records were found to he in compliance, as shown nn the attached records checklist <br />c:/word/terror/insp l 106 <br />
