ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_~9e~_n~I <br />INSPECTION DATE: R/11/ns INSPECTOROS INITIALS: ~- <br />OBSERVATION <br />The Division conducted a monitoring inspection of the site as part of sites <br />to be inspected during the fiscal years, 2005/06 to make sure the operation <br />is in compliance with the Mined Land Rules and Regulations. The site is 112 <br />sand and gravel operation located approximately 1/2 mile East of highway <br />207 and a mile south of the town of Mnazanola, CO. Present during the <br />inspection was Mr. Alfred Nesselhuf, the operator. The site covers 92 acres <br />in the permit area with phased affected acreage of 15. <br />Permit sign and boundary markers properly posted. The gravel being mined is <br />as is the case with most operation in these areas is an alluvial river <br />terrace of the Aransas River. The water table is very shallow in the area. <br />The mining plan calls for the operator to stay two to four feet above the <br />water table. There was no water exposed in the pit floor at the time of the <br />inspection and the site was not active. Prior to the site being transferred <br />to the present operator, All. Right Ready Mix mined it. There were large <br />quantities of processed material located through out the affected acres. <br />The only activity in the past year has been removal of material from <br />existing stockpile. <br />Mr. Nesselhuff wanted to know how to lower his financial liability of <br />$36,000, that is in place for the 15 affected acreage. He was informed to <br />start reclamation and request a financial warranty reduction. Once the <br />backfill and grading work is completed, he can request a financial warranty <br />reduction and the Division will adjust the warranty based on the affected <br />acreage in place, He also wanted to know, if he still needed to pay the <br />$688.00 annual fee. He was informed as long as the permit was active; he <br />will still need to pay the annual fees, However, if the existing <br />disturbance is less than 10 acres, the operator can convert the application <br />from the existing 112 covering more than 10 acres to a 110 construction <br />permit covering permit areas of less than 10 acres.
