(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1985-184 <br />INSPECTION DATE 3/13/03 <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the Killion Supply sand and gravel mine conducted by Erica <br />Crosby of the Division of Minerals and Geology. Jamie Killion of Killion Supply Company <br />was present during the inspection. , <br />An 112c Mining and Reclamation Permit was issued to Charles Nauta on February 18, 1986 for <br />a total permit area of 11 acres. The permit was transferred to Killion Supply Company on <br />October 9, 1998. The Division holds a financial warranty in the amount of $14,500.00. <br />The mine is located 1 mile north of Ft. Collins in Larimer County, Colorado. No mining <br />was actively taking place during the inspection. Rather, the area is used to store used <br />concrete, asphalt, overburden material and topsoil. The materials are stored and recycled <br />on site. The eastern portion of the site contains mostly concrete material mixed with <br />overburden. The western side contains overburden material, topsoil and broken asphalt. <br />The mining and reclamation permit is not clear regarding the storage and recycling of this <br />off site material. The operator will need to revise the permit in the form of a technical <br />revision describing this practice. The operator will need to explain the nature of the <br />material stored on site, the source of the material, and the expected volume to be stored <br />on site. In addition, the reclamation plan may need to be revised if any of this material <br />is to be used to reclaim the site. The technical revision to the permit must be submitted <br />by May 13, 2003. See page 3 for further detail. <br />The original application submitted in 1985 depicts a final groundwater lake 6.5 acres in <br />size. The remaining area is to be graded, topsoiled and seeded. It was noted during the <br />inspection that the groundwater lake is approximately 2-3 acres in size. No grading of <br />the lake has been conducted to date. It appears that the mine has reached the eastern <br />limits along the Eaton Ditch and the Union Pacific Railroad. The operator should conduct <br />some reclamation of the pond slopes in this area. The approved grading slope along the <br />shoreline is a minimum 3H:1V from 5 feet above to 10 feet below the expected water line. <br />A 2H:1V slope can be established beginning at the end of the 3H:1V slope and extended to <br />the bottom of the excavation. All wood products need to be removed from the shoreline, and <br />not incorporated into the reclamation plan. <br />The Division contacted the Office of the State Engineer (OSE) to determine if there was an <br />approved substitute supply plan, or plan of augmentation. According to the OSE, the <br />previous operator, Charles Nauta, provided a plan of augmentation in Court Decreed <br />#90CW129. The replacement water is derived from the Griffin and Nauta water rights. <br />Typically, the operator is required to submit reports to the OSE regarding the plan of <br />augmentation. For additional information on this issue, the operator can contact Dave <br />Netels at 970-352-8712.
