Page 129 <br />Hazd Rock/Metal Mining Rule 6 <br />permit azea, aze obtained after the submission of the Environmental Protection <br />Plan, the Operator/Applicant will provide the Office the same information <br />within thirty (30) days of receipt. <br />(d) The Boazd reserves the right to deny an application for a <br />Permit or Modification to an existing Permit where there is substantial <br />evidence that the operation is or may be contrary to the laws or regulations <br />of this state, or the United States, including but not limited to aIl federal, state, <br />and local permits, licenses and approvals. The Boazd may continue the <br />consideration of the application, or condition approval, pending final <br />resolution of the matter. <br />(5) Designated Chemical(s) Evaluation - an Environmental Protection Plan <br />shaIl contain a presentation and discussion of the types, quantities, and concentrations <br />of designated chemicals within the permit area, and to the degree such chemicals aze <br />present or used within the permit azea, shall chazacterize the designated chemicals as <br />to: <br />(a) their known potential to affect human health, propeRy or the <br />environment; and <br />(b) based on the best information avarable at the time of submittal <br />of the Environmental Protection Plan, specify the expected concentrations, <br />process solution volumes and fate of designated chemicals to be used in <br />existing and proposed extractive metallurgical processes at the mine, and/or <br />mill site, if applicable. <br />(c) Provide, to the extent reasonably available, material safety data <br />sheets for designated chemicals. <br />(6) Designated Chemical(s) and Material(s) Handling - <br />_ (a) -Fully describe- the procedures- -for- -the -disposal, <br />decommissioning, detoxification or stabr7ization for all designated chemicals <br />and toxic or acid-forming materials. Specifically describe measures to be <br />taken to prevent any unauthorized release of pollutants to the envixonntent. <br />Include adequate reclamation and closure practices for such designated <br />chemicals, toxic oracid-forming materials and how unauthorized dischazge of <br />acid mine drainage will be prevented. <br />(b) Submit a narrative description or plan that: <br />
