III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on February 2, 2005 by Mike <br />Boulay of the DMG. Roy Kazo of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were sunny and cold. The mine site was partially snow covered. <br />Higher elevations at the site were entirely snow covered. Coal was being hauled from the Wolf <br />Creek pit in the Yoast South Area and the dragline was operating in the south end of the Wolf <br />Creek pit. Although there were no dozers operating at the time of the inspection, backfill and <br />grading operations are continuing in the south Valora pit. <br />Availability of Records <br />All required records were on file and available for review at the mine site office. No problems <br />were noted with the records review. See the attached Availability of Records checklist. <br />Roads <br />Haul Roads A and B and the road into the active pit azea were clear of snow and frozen hard at <br />the surface. Haul roads site wide were well maintained. Haul Road B was being bladed at the <br />time of the inspecfion. Ditches and most culvert inlets and outlets along Haul Road B were snow <br />covered. The scraper pit and the active Wolf Creek pit in the Yoast South Area were accessible <br />and inspected. Haul Road D and the North Pit area were not accessible due to drifted snow and <br />icy road conditions. <br />Hydrolo¢ic Balance <br />All site sedimentation ponds were inspected including Ponds 010, 011, 012, 013, and 014. The <br />surfaces of all ponds were frozen and snow covered. Ponds 010, 012, and 013 were full and <br />dischazging small amounts of clear water. Water levels in Ponds 011 and 014 were well below <br />the level of the principal spillways. Pond inlets and embankments at all sediment ponds were <br />snow covered. No problems were noted at any of the sediment pond locations. <br />The lower Armand Draw drainage was inspected. The drainage was not entirely accessible due <br />to the snow cover. This location was last inspected in November 2004. As indicated in the <br />November Inspection Report (please see Inspection Report issued 11/17/04) the Division <br />requested that the check dams at the lower and upper ends of the drainage be repaired and <br />reinforced with lazger rock. Since that inspection, the two lower rock check dams and the first <br />check dam below the Culvert YB-6 have been repaired and built up with lazger riprap. <br />
