III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of CDMG. Rick Mills represented the operator. <br />Henry Austin of OSM concurrently conducted an oversight inspection focusing on off-site impacts of a site in <br />temporary cessation. <br />The mine has been in temporary cessation for several years. The weather was warm and clear. The ground <br />was dry. Vegetation is turning brown. Conditions were very dry as significant rain has not fallen for more than <br />a week. <br />RECORDS AVAILABILITY: The records checklist is attached. All required records were available. <br />SIGNS AND MARKERS: The following signs and markers were properly displayed: mine i.d. signs, <br />disturbance area boundary markers, stream buffer signs, and topsoil markers. <br />ROADS: In excellent shape. <br />HYDROLOGIC BALANCE: The #9 mine dewatering well (7 Angle N) was not discharging. <br />Ponds - No ponds were discharging. Ponds 9P2 and 9P3 (NPDES ouffall 024) were about 80% full of <br />water. The flume at NPDES 024 appeared to be in good repair. Other ponds were dry. The <br />embankments and inslopes of all ponds were well-vegetated and appeared stable. Spillways appeared <br />to be in good condition. <br />Culverts - No problems were found. Erosion at inlets or outlets was not evident. <br />Ditches -All appeared to be maintained to design specs. <br />Monitoring wells - No problems were found with monitoring wells. <br />PROCESSING WASTE: No activity, no change. <br />SUPPORT FACILITIES: No problems were found in any of the facilities areas. <br />TOPSOIL: Stockpiles were well-vegetated, were not Bullied, and were properly marked, with one exception: <br />the stockpile southwest of the #9 portals pad is starting to get bare due probably to cattle grazing and/or prairie <br />dogs. The operator's representative explained the stockpile will be seeded and protected from grazing. <br />SLIDES AND DAMAGE: None. <br />
