PUBLIC NOTICE
The Colorado Division of Minerals and Geology proposes to reduce the inspection frequency for the
Fruita No. 1 and No. 2 Mines (File No. C-81-015) from an average of 12 inspections per year to a
minimum of 4 inspections per year, one per quarter.
The Fruita No. 1 and No. 2 Mines is an abandoned, bond forfeited underground coal mine located in
Mesa County, approximately 12 miles north of Fnrita, at the base of the Bookcliffs. The mine site
is located within the NW1/4NVJ1l4 Section 29, and NE1J4 Section 30; Township 8 South, Range 101
West of the 6th Principal Meridian.
The surface disturbance azea at the mine site is approximately 12 acres, with a total affected area
(including underground workings) of approximately 16 acres.
The Division is proposing to reduce the inspection frequency because the site has been largely
reclaimed, and poses no imminent threats to public health and safety, or significant environmental-
harms to land, air, or water resources. Site conditions generally change very little from month to
month. Quarterly inspections will be sufficient to monitor success of vegetation establishment and -~
identify developing problems which may require maintenance. Remaining forfeited bond funds in the
amount of $28,349.00 aze available for remedial measures, or site maintenance, if deemed necessary.
This decision is based on a complete inspection and a written finding as required by Rule 5.02.2(8)(a)
of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the
regulations promulgated thereunder. Copies of the written finding are on file for public inspection at
the Colorado Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman
Street, Denver, Colorado 80203; at the Division's Grand ]unction Field Office, 2148 Broadway #C-5,
Grand Junction, Colorado 81503; and at the Mesa County Clerk's Office, 6th and Rood, Grand
Junction. Persons with an interest that may be adversely affected by the proposed reduced inspection
frequency may submit written comments to Dan Mathews, at the Division's Grand Junction Field
Office, within thirty (30) days of publication of this notice.
