III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evitlence <br />supporting the enforcement action. <br />On January 18 an inspection was conducted at the Fruita Mine. At the time <br />of the inspection it was cold and there was considerable snow cover. <br />Present at the inspection was Earl Madden (telephone# 464-5380) who is the <br />contractor reclaiming the mine. During the inspection the mine was being <br />actively reclaimed under an approved reclamation plan and schedule. <br />The American Shield, the operator of the Fruita Mine, is required by the <br />approved reclamation plan and as an abatement to t3OV C-90-030 to complete <br />backfilling and Grading of the site by December 23, 1990. As of this date <br />it appears that this mine has abated the violation and the violation is <br />hereby terminated. <br />The Anchor seam bench had been backfilled to the sandstone outcrop at <br />slopes much shallower than 2:1. The Cameo Bench fill had been cut back to a <br />2:1 slope except at the access road which could not be cut back without <br />loosing part of the road. Topsoil like material was found while cutting <br />back the bench and this was used to cover the recontoured bench outslope. <br />During the recontouring of the anchor bench, and reestablishment of the <br />east drainage, coaly material from the prelaw Farmers mine was unexpectedly <br />encountered. Several options were discussed, but ultimately the drainage <br />will be covered with an inert material. Other problems encountered in the <br />west drainage were unexpected sandstone outcrops that will be left as Is as <br />natural drop structures. <br />
