III. Comments - Compliance
Below are comments on the inspection. The comments include discussion of
observations made during the inspection. Comments also describe any
enforcement actions taken during the inspection and the facts or evitlence
supporting the enforcement action.
On January 18 an inspection was conducted at the Fruita Mine. At the time
of the inspection it was cold and there was considerable snow cover.
Present at the inspection was Earl Madden (telephone# [phone]) who is the
contractor reclaiming the mine. During the inspection the mine was being
actively reclaimed under an approved reclamation plan and schedule.
The American Shield, the operator of the Fruita Mine, is required by the
approved reclamation plan and as an abatement to t3OV C-90-030 to complete
backfilling and Grading of the site by December 23, 1990. As of this date
it appears that this mine has abated the violation and the violation is
hereby terminated.
The Anchor seam bench had been backfilled to the sandstone outcrop at
slopes much shallower than 2:1. The Cameo Bench fill had been cut back to a
2:1 slope except at the access road which could not be cut back without
loosing part of the road. Topsoil like material was found while cutting
back the bench and this was used to cover the recontoured bench outslope.
During the recontouring of the anchor bench, and reestablishment of the
east drainage, coaly material from the prelaw Farmers mine was unexpectedly
encountered. Several options were discussed, but ultimately the drainage
will be covered with an inert material. Other problems encountered in the
west drainage were unexpected sandstone outcrops that will be left as Is as
natural drop structures.
