III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br />and Safety. Byron Walker of CDRMS accompanied the inspection as well. The mine is a reclaimed <br />surface mine, with no personnel on site. The weather was clear and windy. The mine site and load out <br />are damp from recent rains <br />Records: Records are stored an NWCC offices in Steamboat Springs. Records were checked on 9/20 <br />and found to be complete and in compliance. Records Availability form is included with this report. <br />Roads: The access road was in good condition to the facilities azea. The operator has completed <br />installation of rock check dams in the access road ditch where down-cutting had occurred. These repairs <br />held up well to the recent precipitation run off, and is an acceptable maintenance repair to the ditch. The <br />access road to the load out remains in fair condition with some sediment deposition from the adjacent <br />slope (outside the permit area) on the road. <br />Offsite Support Facilities: The loadout pond was holding a pool of stagnant water, approximately 16 to <br />18 inches below the discharge pipe elevation. The pond was very moss choked. Vegetation on the <br />loadout was in good condition. <br />Hydrologic balance: None of the sediments ponds at the mine site, F, E, D, or A were discharging or <br />showed sign of having discharged recently. All ponds were holding pools of water from recent rains. <br />Pond F has a very shallow pool of water and is currently under review to remain as a permanent structure <br />(TR22). Repair to ditch PD3 remains in good condition. The operator has added some additional rock <br />to the northern end of PD3 immediately east of County Road 12. Pond embankments and hydrologic <br />control ditches are in good repair and adequately vegetated. One limited length gully was observed east <br />of Pond F. Runoff is concentrated off the county road and has dovvncut approximately 1 to 1/''/z feet <br />over approximately 15-20 feet. This runoff is eventually caught in Pond F and does not appeaz to be <br />contributing large amounts of sediment to the pond since no sediment delta is associated with the inflow <br />azea. <br />Reve etation: Vegetation throughout the mine site appeared very good though mine site. Pit 1 <br />vegetation is in very good condition. Some Canada thistle was noted in the drainage of Pit 1, but extent <br />was limited and not considered an infestation. The vegetation on the reclaimed G pond area is sparse but <br />perennials are starting to establish. Numerous annual species dominate the pond G reclaimed area as <br />expected during the first growing season since the area was seeded. <br />3 of 5 WHITE -File YELLOW -Operator PINK -Specialist <br />
