III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Sediment Pond 10 was dry, with sediment levels approximately 6 feet below the emergency spillway level. <br />The rock drop structures along the permanent diversion segment of the Coal Creek Channel have been <br />partially removed. Complete removal of the rock swctures and excavation of the channel to establish the <br />design grade is to be completed during the I"quarter, 2002, in conjunction with CRDA-l and CRDA-2 <br />final reclamation. <br />Cameo Borrow Area I sediment sump wasdry, with sediment level approximately 4.5' below the outlet <br />elevation. <br />North Portal Facilities <br />Further grading had been conducted at Pond 12 when viewed on December 14. Subsequent to the initial <br />grading work observed on November 20, the pond bottom had been smooth graded in [he area along the <br />base of the embankment, where cracks had been filled in, with a slight slope established away from the <br />base of the embankment toward the center of the pond. Following approval of Minor Revision 54, on <br />December 18, Pond 12 was partially reclaimed by grading down the embankment between Pond 5 and <br />Pond 12, so as to preclude the potential for water storage in Pond 12. The grading work performed was <br />adequate to satisfy Abatement Step 2 of the modified NOV, and as a result the NOV has been terminated. <br />Pond 5 was dry. Clean-up operations in the area between Pond 5 and the supply storage area had resulted <br />in mud and debris being pushed up into the vicinity of the rock inlet to Pond 5, along the lower end of the <br />road dip. The debris needs !o be removed so that the road dip will drain freely into Pond S. <br />The supply storage yard has been largely emptied, with only a small quantity ofrubbilized concrete, several <br />transformers and fan components, a few culverts, a couple underground water tank trailers, some cable <br />spools and miscellaneous items remaining. The perimeter fence had been taken down and the concrete set <br />metal fence poles had been pulled out. Most of the fence poles were on the ground where they had been <br />pulled. The perimeter berm around the storage yard area remained intact. A quantity of dismantled <br />conveyor components had been stacked in the comer of the yard area just to the north of the formerly <br />fenced supply storage site. <br />The old abandoned septic system to the south of the upper end of the portal decline had been pulled out. A <br />collection ditch in this vicinity had been partially blocked by the excavation work, and needs to be cleaned <br />our to restore the design ditch grade to the cuivert into Pond S. <br />A[ [he North Portal Decline, there had been a methane fve incident on December 3, 2001. Methane <br />emanating from the old fan shaftbackfilled from inside the mine had ignited, apparently due to prior <br />cutting torch opetations in the vicinity. Flames were confined within thevertical metal fan shaft frame <br />structure associated with the entry. The fire had been discovered by Tonya Hammond, and was reported to <br />the local fve department, MSHA, and DMG. The fve was extinguished by the fire department with water <br />and foam, and the steel fan frame structure was partially filled in with concrete, completely covering the <br />fan portal opening. Gas readings made by MSHA on December 5 indicated that the fve had been <br />
