III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Reclamation". Fan and electrical components previously stored at the junction of the reclaimed South Fan <br />access road and the 2 West Portals road had been removed. <br />North Decline Area <br />The North Decline reclaimed area was largely snow-free. Sediment control ditches andbenns were intact <br />and properly maintained. Pond 7 and the two SAE sumps were dry. The reclaimed stream channel <br />contained a shallow frozen pool in the low spot near the sumps. The Ute Water pipeline corridor was <br />revegetated in the fall of 2000 and good establishment of seeded shrubs and grasses was achieved. <br />Topsoil and overburden from excavation associated with drill pad development for drilling of the new mine <br />dewatering hole associated with new Discharge Site 016 have been stored in two separate stockpiles near <br />Pond 7. /( appears !ha! recently a small quantity of mud from the drill site was placed immediately <br />adjacen( to the (opsoil stockpile. The material is currently frozen. This mud should be moved into the <br />overburden stockpile area, awayfrom the topsoil to avoid the potential jot conlaminarion ojlhe topsoil <br />when i! thaws. <br />A small rectangular "bare area" in (he upper southeast portion of [he reclaimed area has been previously <br />noted, and the operator has a(templed remedial measures in the pas! that have jailed. The surface soil in <br />[he bare area is apparently not sui(able as plant grow(h material. It is recommended !ha[ the s:trface soil <br />be removed from the site and baried deeply at an appropriate location in one ojlhe t[pcoming final <br />reclamation backfr!! loco(ions such ar the decline at the North Portal. The soil removed should be <br />replaced with a similar quantity ojsui[able soil from one oj[he approved soil borrow areas, and the area <br />should be reseeded <br />Drilling has been completed at the 016 angled drill site near the North Decline, and operator indicates that <br />the workings were penetrated and the hole successfully completed. The pad location has been partially <br />backfilled, and adequate sediment control berms and silt fencing installed. However, a significant amount <br />of work remains to be done before the discharge will be operational. This includes trenching for <br />installation of the 8 inch dewatering pipe at the required depth to the existing culvert beneath 1-70, followed <br />by final backfilling, grading, topsoiling, revegetation, and final sediment control installation at the drill pad <br />location. <br />CRDA-I and adjacent areas <br />The west end of Terrace drain #4 and bench outslopes immediately above and below the drain have been <br />re-graded close to design grade, in preparation for £nal reclamation cover placement. This terrace re- <br />grading was conducted along a segment extending approximately 220 yards from thewest end. Beyond <br />that, re-grading has not been initiated, and the slope crestjust below the terrace drain remains obviously <br />over-steepened. At a representative location along the graded segment, over-all slope between Terrace <br />Drain #3 and Terrace Drain #4 was estimated at 45%, using an abney level and stake. Slightly steeper, 4 <br />foot segment at the crest of the slope immediately below Terrace Drain #4 was estimated at 52%. <br />Some clean-up grading is necessary at the west end of Terrace Drain #3, to clean ojjcoal pushed down <br />during grading, and to better defrne the terrace inlet into the perimeter ditch.
