III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the facts of evidence supporting the enforcement action. <br />This aerial inspection report is prepared by Byron G. Walker from aerial photographs [numbers 19- <br />03-12-16-105 through 143 on file at the Divisions taken on December 16, 2003, by, and an oral <br />debriefing of, Mr. Harry Ranney, Environmental Protection Specialist of the Division. Mr. Ranney <br />stated that he saw no problems at the site. Copies of the aerial photographs have been provided <br />to Colowyo Coal Company, L.P. by e-mail. The photographs provide a comprehensive overview <br />of the site under snow-cover conditions. <br />All aspects of the operation appear to be as permitted. Some coal dust is noted for a short <br />distance away from the Gossard Loadout in a few of the photographs. Colowyo operates under <br />Facility Wide Air Permit No. 95MF1040 of the Colorado Department of Public Health and <br />Environment. <br />Page 3_ of 4 Pages, Date 22 December 2003 ,Initials _BGW <br />
