In December, 1995, four barrels of toxic waste (containing PCBs) were removed from <br />the Hawk's Nest site by Walsh Environmental and disposed in a licensed facility out of <br />state according to EPA regulations. <br />The East Mine area was treated again in November 2000, with control of noxious weeds, <br />erosion control, soil amendments, addition of growth medium obtained from the CDOT, <br />revegetation, and the disposal of debris and metal roof bolt hazards. Since that time, <br />annual weed spraying has been conducted by the Gunnison County Weed Control <br />agency. <br />Risks to Public Health, Safety and Environment <br />There are several structures remaining on the site. Drainage structures were constructed <br />to handle the 100-year, 24-hour event. A sediment pond remains at the silo azea. The <br />pond is located in a well-vegetated area adjacent to the North Fork of the Gunnison <br />River, beside an abandoned electrical substation of the Delta-Montrose Electrical <br />Association (DMEA). <br />There are several areas where material from the cut slope above the old state highway <br />133 periodically slumps onto the roadway. These locations coincide with topography on <br />the bench above the cut slope where meteoric water tends to pond, and a spring. The <br />roadway carries very little traffic, being used seasonally by hunters and as an alternate <br />entrance to the Oxbow Mining LLC facilities. The slumps appear to represent a minimal <br />risk to public health, safety and the environment and are primarily a nuisance. These cut <br />slopes appear to be associated with the old highway, not with the mining itself. <br />The site is not located near or above any urbanized areas, communities, occupied <br />dwellings, schools, or other public or commercial buildings or facilities. <br />Sediment and Erosion Control Function <br />Rip-rapped ditches aze in place at the East Mine site. The recent reclamation of that <br />portion of the mine left a roughened surface on the slope of the reclaimed area above the <br />river. That rough surface, along with slash that was spread on the surface, has helped <br />prevent erosion in the four years since the work was accomplished. <br />Before the slope was reworked, there was no evidence of erosion or sediment transport <br />into the river. A small berm runs most of the length of the slope just above the river <br />bank. In seven years of inspections, there has never been any evidence that the berm has <br />been breached or that any water or sediment has escaped over or through the small <br />structure. <br />There has been no evidence of erosion at the West Mine area. There is also arip-rapped <br />drainage channel on that site. <br />
