<br /> <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments in Section IV describe any enforcement actions <br />taken during the inspection and the facts or evidence supporting the enforcement action. <br />(4) The use shall not involve unreasonable delays in reclamation. <br />(5) Necessary approval of measures to prevent or mitigate adverse effects on fish, wildlife, <br />and related environmental values and threatened or endangered plants shall be obtained <br />from the Division and appropriate State and Federal fish and wildlife management agencies. <br />Such agencies shall have a 60-day period in which to review the plan before surface coal <br />mining operations begins. <br />(6) Proposals to change premining land uses of range, fish and wildlife habitat, forest land, <br />hayland, or pasture to a postmining cropland would require continuous maintenance such as <br />seeding, plowing, cultivation, fertilization, or other similar practices to be practicable or to <br />comply with applicable Federal, State, and local laws, shall be reviewed by the Division to <br />ensure that: <br />(a) There is sufficient water available and committed to maintain crop production; and <br />(b) Topsoil qualify and depth are sufficient to support the proposed use. <br />Attachments; <br />Page 2.05-61 <br />Photograph 7-02-01-30-3g <br />Photograph 7-02-01-30-4g <br />Photograph 7-02-01-30-5g <br />Photograph 7-02-01-30-bg <br />C-BO-007, Page _1~_ of _11_ Pages, (date) _4 February 2002 (initials) _BGW <br />
