<br />Mineral County/M-84-097 <br />page 2 <br />As the new map is drawn, however, the procedure will involve a <br />couple extra steps, which I will try to explain. As mentioned <br />above, the boundaries of the new large permit only annroximately <br />cover the two existing permit areas. There are three small corners <br />of existing permits that are shown to be outside the new <br />rectangular permit. These areas, because they would not be within <br />the new boundary, will have to be "released," a separate step to be <br />done prior to all other steps. Release is possible only if those <br />areas have not been disturbed by mining or if they are fully <br />reclaimed. The formal requests for release, following Minerals <br />Rule 4.16, would have to be made by CDOT for their NE and NW <br />corners, and by Mineral County for their SE corner. This need for <br />requesting release can be eliminated by drawinu the new rectangular <br />boundary line larger, thereby taking in all of the existing permit <br />areas. Be reminded that 112 permits may range in size from 10 <br />acres and larger, and that not all of it has to be disturbed by <br />mining. <br />The next step would be to apply for the new 112 permit, based on <br />the new proposed boundaries. It does not matter that reclamation <br />is not complete in the CDOT pit. By taking in that area, you will <br />agree to assume any outstanding reclamation liability. I see by <br />the new map that the new area is about 23 acres, putting it into <br />the size category for 112 a permit. I have enclosed a 112 <br />application with this letter for your use. After the 112 permit is <br />issued, the two existing 110 permits will be terminated. <br />For your information, on this matter and future ones involving your <br />county gravel pits, our agency has an office in Durango. I am <br />sending a copy of this letter, Mr. Hager's letter and the new map, <br />to the Durango office. You should contact that office for any <br />questions you may have. The staff of that office will be <br />responsible for follow up and inspections in your county. Feel <br />free to contact them - the staff there is really super.
