III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a complete inspection conducted by Tom Kaldenbach of DMG. Rick Mills represented the operator.
With the operator's consent, this report was not issued in the field.
The mine has been in temporary cessation status since 1995. A maintenance crew was on site. The fan was
operating at the 5A portal. Conditions were dry due to a statewide drought.
RECORDS AVAILABILITY: The records checklist is attached. All required records were available.
SIGNS AND MARKERS: The following signs and markers were properly displayed: mine i.d. signs,
disturbance area boundary markers, stream buffer signs, and topsoil markers.
ROADS: Roads were in excellent shape. A water truck was spraying the main road for dust suppression
during the inspection.
HYDROLOGIC BALANCE:
Monitoring - I checked recent hydrologic monitoring data for compliance with the monitoring
requirements in Exhibit 29 of the permit application. All monitoring requirements appeaz to have been
met. Empire is currently following its "Temporary Cessation Monitoring Plan", as described below.
Station Location Parameters Frequency Recent Sample Date
name and Comment
Same as in
All Same as in active active (Not covered in this
NPDES vazious mining monitoring mining inspection.
