M-77-227 <br />Dear Mr. Stevens: <br />I am responding to your concerns and comments from your <br />inspection of 3/12/97. You had two main concerns as follows: <br />Boundary Markers: <br />Pat Maestas, my operations manager for Colorado Aggregate <br />Company, has just recently been promoted to his neta position. At <br />the time of the inspection, he was not ataare of the boundary <br />markers for the permit area. The boundary has been surveyed with <br />each corner marked with re-bar and a registered surveyors' cap. A <br />short fence post has been placed next to these markers. Since your <br />inspection, Mr. Maestas has taalked the permit boundary and located <br />the questioned markers. Please contact him to walk the boundary <br />with you on your next visit. <br />Length of Operation: <br />Our annual report shores and N,r. Maestas indicated to you at <br />the time of your visit that we operate less then 180 days per year. <br />our mobile crushing plant does in fact operate less than 180 days <br />per year crushing the material into stockpiles. Hotaever,tre remove <br />the material from the stockpiles, conduct stripping operations, <br />conduct reclamation operations, and perform other mine related <br />activities throughout the year. Typically vre have some type of <br />activity minimally at least 3 to 4 times per week the rest of the <br />year between crushing cycles. Because of the confusion of what <br />actually constitutes "operating", I called your office April 25, <br />1997 and visited with Mr. Greg Squires in your absence. Mr. <br />Squires indicated these other activities should be considered as <br />"operating" and as such tae should be classified as operating more <br />than 180 days per year. If that is the case, our annual report, <br />which was submitted January 13, 1997, should be changed to indicate <br />we operate MORE than 180 days per year. <br />
