III. COMMENTS • COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. <br />Comments also describe any enforcement actions taken during the inspection and the facts of evidence supporting the <br />enforcement action. <br />southwest corner of the Work Area Pond. <br />TOPSOIL <br />Topsoil Pile 16D had been shaped and graded, and was in good condition (no erosion features). This storage <br />pile still needs to be protected (by vegetative cover or other means). <br />GENERAL MINE PLAN COMPLIANCE <br />Operations were in compliance with the general mine plan. Multi-seam open-pit mining of overburden and <br />interburden by draglines and truck and shovel was underway in the West Pit. Coal was being out-loaded by <br />front-end loaders into trucks, assisted by dozers. Highwall mining was underway in the East Pit. There was <br />no activity in the Section 16 Pit. <br />FISH AND WILDLIFE <br />Turkey vultures had returned to the mine site. <br />SPECIAL CATEGORIES OF MINING <br />Highwall mining was underway in the East Pit. See GENERAL MINE PLAN COMPLIANCE above. <br />OTHER <br />Colowyo had experienced a hghwall collapse at the west end of the West Pit, and a highway coal truck had <br />caught fire. There were no injuries. Highwall stability is being reevaluated, and all the other coal haul trucks had <br />been inspected. <br />Page 4 of 5, April 26, 2005, BGW <br />
