The letter from the <br />Division dated November 2, 1995, included Mr. Pendleton's memo dated August 31, 1995, to <br />Ms. Christine Johnston. Because Mountain Coal Company was not in receipt of the memo until <br />November 2, 1995, the 3rd Quarter 1995 Pond, Stockpile, and Mine Site Inspection Reports did <br />not contain the information Mr. Pendleton requested in his August 31, 1995, memo to Ms. <br />Johnston. <br />The information requested by the Division was submitted with the 4th Quarter Pond, Stockpile, <br />and Mine Site Inspection Reports. I have instructed Mr. Norm Johnston, a professional engineer <br />with Lambert and Associates (Mountain Coal Company's contractor), to contact Mr. Pendleton <br />and rectify any additional concerns the Division may have regarding the compaction monitoring of <br />the Lower Refuse Pile. <br />If you have any questions regarding the attached letters from Lambert and Associates, please <br />notify me. <br />
