III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action, <br />This permit is in temporary cessation. There is no operational, other than occupation of the office <br />building and routine maintenance, activity at the site. John Weinman ofHydro-Environmental <br />Solutions, Inc. was contacted by telephone, but did not join in on this inspection. <br />Hydrologic Balance <br />There was no discharge from Sedimentation Ponds 1 and 2. There were no surface inflows to the <br />ponds. <br />Backfill and Grading <br />Remaining backfilling and grading requirements are associated with long-term facilities. No <br />reclamation backfilling and grading have been accomplished at the site. <br />Supnort Facilities <br />The office building and trailer are occupied and aze in good repair. Sedimentation ponds and ditches <br />aze in good repair. Other structures are in disrepair. Some structures have been vandalized. Temporary <br />repairs have been made. <br />Equipment was on site appropriate to cleaning of culverts, but no cleaning was evident at the time of <br />this inspection. <br />General Mine Plan Compliance <br />The site is in temporary cessation. No permitted work to covert the site from a coal rail load-out to a <br />coal rail load-in facility had been accomplished. <br />Reve¢etation <br />Remaining revegetation requirements are associated with future reclamation of long-term facilities. No <br />reclamation revegetation has been accomplished at the site. <br />Air Resource Protection <br />The site is stable with regard to air protection. There is no dust-generating activity at the site. <br />Slides and Damage <br />There is an arrested slide, recorded in May 2000, at a cut on the railroad spur. The head escarpment is <br />neaz the permit boundary. There was no advance of the slide. <br />C-1992-081, CP inspection of 21 August 2007, page 3 of 5 pages <br />
