(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2001-054 <br />INSPECTION DATE 5/7/07 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This partial inspection was performed by the Division as part of its monitoring of Construction Materials 110 permits, and due <br />to a claim by the US Forest Service that there may have been offsite damage or a trespass issue, by the operator outside the <br />permit boundary of USFS land. The inspection was performed without scheduling it or contacting the operator prior to arriving <br />onsite. There was no activity and no operator present during the inspection. There was no USFS staff onsite during this <br />inspection. There was no snow at the site. <br />The required permit ID sign and boundary markers were posted. <br />The channel constructed for conveying creek flows down the south edge of the site was more deply incised that previously <br />observed. It passes under the pit entrance road via a single spiral culvert, though portions of it have been damaged and are <br />not crossable now. There have been two culverts in the past, both originally being longer than the single one present now (one <br />of the culverts was completely damaged and observed on the ground at the crossing). The road width is now very narrow now. <br />If the remaining culvert becomes further damaged or for other reasons the channel flow moves into the pit or goes down the <br />road, instead of settling out in the pond, this may become a problem. Timely repair to the culvert(s) is urged. <br />The unpermitted land above the permit area, belonging to USFS, was inspected. It appears that a small dozer did, in fact, <br />access that area uphill from the permit, and push some material into a small levee possibly to contain the upper part of the <br />runoff channel. The runoff from uphill is presently contained in a natural channel that has not meandered significantly and still <br />enters the permit area in the constructed channel. This site and the channels (present and past) are located on an alluvial <br />debris fan, and should be regarded as unstable. If the active natural channel migrates to the north it will not be contained in the <br />constructed channel as it crosses the site, and will damage the graded surfaces by rapidly eroding them, and transport <br />sediment offsite since it will not be controlled in the pond. The operator clearly has an interest in maintaining the flow in the <br />present channel, and the USFS states that the operator performed the levee building on their land. This inspector did not see <br />such activity occurring, but agrees that an earthmoving activity probably did occur. The operator is cautioned against <br />pertorming mining or reclamation activity on lands outside the permitted area. This activity does not actually constitute either of <br />those, and no DRMS enforcement action will result, but the operator is nevertheless urged to obtain permission from USFS <br />before enter their lands. <br />No further items were observed during the inspection. Responses to this inspection report should be directed to the Division of <br />Reclamation, Mining and Safety, 701 Camino del Rio, Room 125, Durango, Colorado 81301, Attn: Bob Oswald; phone no. 970- <br />247-5193. <br />Cont. <br />Most of the permit area excavation has been completed, and most of the reclamation earthwork and grading have been <br />completed. Pit slopes are at their final gradients, and no erosion is evident. There are several pieces of equipment and a <br />limited amount of smaller items stored onsite, that are mining- orconstruction-related. Some revegetation was observed at the <br />site, most of it consisting of thinly scattered young grass seedlings. <br />
