ORIGINAL -PUBLIC FILE <br />Page 2) <br />MINE ID # OR PROSPECTING ID #: M-19R~-n44 <br />INSPECTION DATE: 8/22/n7 INSPECTOROS INITIALS: ~~ <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2007 and 2008. Present during the inspection was Mr. <br />Jerry Johnston, the operator. <br />1) Site is a small 7 acres sand and gravel operation located in between Woodland Park <br />and Divide Colorado along the west side of Highway 24. <br />2) Site was not active at the time of the inspection, however recent mining activity <br />along the South west side of the permit was noted. According to the annual report, <br />approximately 200 yards of material was removed from site in 2006. <br />3) There was some significant water that was ponded along the same area. Mr. Johnston, <br />who owns a lot of acres in the area stated that he has water rights both in Trout <br />Creek & Blue creek, that will compensate for the evaporative loss from the pond. He <br />was informed with out the appropriate water rights, operator's are only allowed to <br />store water for 72 hours from a single event. <br />a) There were some mining related and other equipment stored along the North side of <br />the permit area. <br />5) Mr. Johnston stated that he plans to amend his permit to increase the permit area by <br />2.9 acres for a total of 9.9 acres. He also stated that the entire area will be re- <br />surveyed and a new map will be provided at that time. That being the case, the <br />current warranty in the amount of $7,000.00 for the approximate 3 acres disturbance <br />appears to be adequate. <br />6) All the surface water drainage appears to be captured with in the affected area.
