III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of DMG. Henry Barbe represented the <br />operator. The ground was dry. With the operator's consent, this report was issued from the Denver <br />office of CDMG. <br />The longwall was active in panel 19. Development work was active in 20 headgate. <br />Availability of Records <br />All required records were on file in the mine office (see attached list). <br />Sins and Markers <br />Mine i.d. signs were properly displayed at the two entrances on Highway 133 and at the corrals <br />staging/laydown area. Topsoil markers were properly displayed on the numerous topsoil stockpiles <br />seen during the inspection. The affected area boundary was properly marked by signs around the <br />perimeter of the disturbed area in the main surface facilities azea. <br />Roads <br />Road surfaces, embankments, and road ditches and culverts were in good repair in the main surface <br />facilities area, Sylvester Gulch, and the West Flatiron area. Regrading, seeding, and mulching of fhe <br />West Flat Iron Road was nearing completion in the S %z Section 23. Aspen trees that had been cut <br />down when the road was constructed were being laid across the reclaimed road as an additional erosion <br />control measure and to restrict access by motor vehicles (see Photo 1, below). This innovative use of <br />on-site materials by the operator is commendable. <br />3 <br />
