• (Page 2) • <br />MINE ID # OR PROSPECTING ID # M-97-094 <br />INSPECTION DATE 02/03/98 INSPECTOR'S INITIALS ASW <br />OBSERVATIONS <br />This inspection was conducted as a result of a citizens complaint. The inspection was <br />conducted by Tony 47aldron of DMG along with Ferd Mueller, who is the operator. The site is <br />located approximately 6.5 miles northeast of Beulah, Colorado near the junction of Siloam <br />Road and Red Creek Road. <br />The complaint identifies four separate concerns as follows: <br />1. Siloam Stone is loading their trucks on the (County) road rather than off <br />the road, and traffic is being blocked on Siloam Road. <br />During the inspection there were no trucks being loaded out at this site. The operator did <br />admit that some trucks have been loaded out on Siloam Road when conditions have been too <br />muddy on the site. The application states that loading of trucks may be done on an adjacent <br />stone yard area along with the mine site, but does not mention that any trucks will be loaded <br />on the road. Since the application does not specifically restrict Siloam Stone with respect <br />to where trucks can be loaded and the Construction Material Rules and Regulations are silent <br />on this issue, this appears to be a local concern which should be addressed at the county <br />level along with the road damage issue (item 4). However, the operator will be asked to <br />clarify their loadout procedures in their permit application through the submittal of a <br />technical revision as identified on page four of this report. <br />2. There appears to be blasting dangers to the public. <br />No blasting was occurring on site during this inspection, however, the operator did admit <br />that blasting had occurred on site. Mr. Mueller indicated that all blasting activities are <br />contracted out through Yenter Companies and the last scheduled blast had occurred on <br />September 19, 1997. The approved application does not contain any information indicating <br />that blasting would be occurring at this site. Since the regulations do address blasting and <br />the potential for adverse off-site damage as a result of blasting, this will be cited as a <br />problem on page four of this report and the operator will be required to revise their permit <br />accordingly. Although, according to the blasting reports from Yenter Companies, there is a <br />very small amount of explosives used, it is possible that off-site damage could occur or <br />safety concerns may arise. <br />3. An inordinate amount of dust is being generated by Siloam Stone's <br />operation. <br />Although no dust was being generated as a result of mining and reclamation activities during <br />this inspection, the possibility that fugitive dust could result from these activities does <br />exist and mining operations are required to maintain a stable site which prevents air and <br />water erosion from occurring. Therefore, the operator will also be required to address how <br />fugitive dust will be controlled at this site with their revision submittal as outlined on <br />page four of this report. In addition. the Colorado Department of Health will be copied on <br />this report so that they can make a determination as to whether any additional permitting may <br />be necessary through the Air Quality Control Commission. <br />4. There appears to be road damage to Siloam Road due to Siloam Stone's heavy <br />trucks. <br />As stated previously, this is a local county matter and should be taken up with the Pueblo <br />County Road and Bridge Department or the county commissioners. Commercial roads are not <br />regulated by the Division of Minerals and Geology and the volume and type of traffic that <br />these roads are designed for is usually addressed in the county special use permitting <br />process. <br />This concluded the inspection. The concerns identified during the inspection have been cited <br />as problems along with their corrective actions on page four of this inspection report. <br />
