Cottony <br />Division Director <br />Natural Resource Tmstee <br />I received your message requesting guidance to address the corrective actions listed in the Division of Minerals <br />and Geology's November 25, 2003 inspection report. The use of imported soil at the site is subject to the <br />notification requirements of Rule 3,1.5(9) of the Mineral Rules and Regulations of the Colorado Mined Land <br />Reclamation Boazd. Since this regulation only requires a notice, it does not constitute a revision or amendment <br />of your exisfing permit. There are no application forms to fil] out, nor are there any application fees to be paid. <br />What is required is a notification, in the form of a letter addressed to my attention, stating that Holcim is <br />providing a Rule 3.1.5(9) notice that offsite soil is being imported to the facility and is being stockpiled for use in <br />reclamation. Be sure to include your permit number (M-1977-348) with the notice. <br />The following information must be included in the notice letter, in the form of a list: <br />(a) A narrafive that describes the approximate Location of the proposed acfivity. This would be a description, a <br />map, or a sketch of where the imported material is stockpiled and where it is intended to be used. <br />(b) The approximate volume of imported material to be used. <br />(c) A signed affidavit certifying that the material is clean and inert, as defined in Rule 1.1(20). An example <br />affidavit is enclosed. <br />(d) The approximate dates the proposed activity will commence and end, however, such dates shall not be an <br />enforceable condition. When did Holcim commence importation of the soil? What is the anticipated date of <br />exhaustion of the imported soil stockpiles to be used for reclamation? <br />(e) A brief explanation of how the imported soil will be used. <br />If you have questions, please call me at 303-866-4063.
