Sea Possible Violation eV-1 on page a <br />of this report. <br />Since Chars are two different diversion Structures under COnsiderati.~n, the bivision <br />wants to clarify the requirements for Chia corrective action. The OErrator initially <br />proposed to use an asphalt `svale' or divercion dike in choir raviaia~.. to the sediment <br />coatz0l plan dated March 27, 1997. As seated in an April 1, 1997. mes,o, the Division <br />believes that a Swale or dike would detrace from the utility of the road. However, the <br />Division will approve installation of an asphalt diversion dike if the Operator submits <br />written verification from the landowners or their representative stating their acceptance <br />of the r.tructure. <br />In the.~bsence of such ari agreement, the Division will require installation of an <br />alternat~a diversion structure. On April 16, 1997, the Operator submitted a schematic <br />for a g:',•.ted transverse ditch and Cattle guard with sn inferred depth of 1&• to 3' from <br />we9t to east. The schematic did not specify the width of the ditch. To oomplece our <br />evaluation of this structure, the wideh and depth needs to be specifies. Whore this is <br />received by the Division and approved, Chia structure can be installed. Ic should be <br />noted that the landowners have expYEBSed their willingness co assist with the <br />insta118tion of this BtruCCUYA. The Division's au[hority ie only with the Operator in <br />regards CO this permit, therefore, we will not participate in any negol.iations between <br />the Operator and the landowner involving its completion.
