III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the CDMG. This site is <br />currently in active status, but for all practical purposes it is in a temporary <br />shutdown status until coal mining at the Lorencito Canyon mine resumes. Ground <br />conditions were dry and the weather was warm and mild. <br />Availability of Records <br />The public copy of the mine records is kept at the small office at the Tri-State <br />railyard south of Highway 12 on the west side of Trinidad. All required records <br />were found in compliance and up-to-date. The results of the records inspection can <br />be found on page 2a of this report. <br />Hydrologic Balance <br />Four ponds and five containments exist at this site. All ponds and containments <br />were inspected. Pond 4 held a small amount of water, well below the primary <br />outlet. The embankment and emergency spillway appeared normal and in good <br />condition. Pond 6 serves as a catchment basin for any prep plant overflow. The <br />prep plant has been idle since early 1996. This pond has no sediment treatment <br />function and was found dry. Pond 7 serves as the sediment treatment pond for most <br />of the disturbed area south of Highway 12. It was recently cleaned of sediment. <br />The pond held a small amount of water in the back of the pond. The spillways were <br />inspected and found in good condition. <br />Two containments at the West Mine were inspected and found in good condition. <br />Both were dry. Three containments serving the RDA conveyor area were also dry and <br />in good condition. The operator should evaluate each of these containments with <br />regard to sedimentation and clean them if necessary when equipment is available. <br />Ditches directing runoff to the ponds and containments were traversed on foot. <br />Particular attention was given to those ditches and culverts that are adjacent to <br />the Purgatoire River. All were found in functional condition. Clean water <br />diversions were also traversed and found normal. Evidence of minimal flows in <br />these ditches was noted. <br />PAW-1 and PAW-2a alluvial wells near the development waste pile were found marked <br />and capped. <br />3 <br />
