Compliance with Colorado Surface Coal .Yining Reclamation Act <br />CRS 2973, as amended 34-33-I01, et. sea., <br />and the <br />Rules and Regulations Zssued Pursuant to the Act <br />This includes a Zistinq of the particular provisions of the regulatory program which were <br />examined during the course of this inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with t5e Rules and Regulat=ons, the Act and <br />the perm; t. <br />4.03 Roads <br />The ditch along the road to sediment pond b2 has been cleaned out recently, and <br />the ditches along the haul road Leading to the portal area are in good shape. <br />4.05 Hydrologic Balance <br />The culvert below the first switchback on the road leading to the portal bench has <br />been cleaned out as requested in the August, 1981 inspection report. <br />The PVC pipe which carries runoff from the portal bench to the collection ditch <br />below the bench has been repaired. <br />The straw dike at the water truck pumping station across from the large coal stock- <br />pile area has not been repaired. The compliance deadline of September 14, 1981 is still <br />in effect for this problem and must be abated by the deadline, or an enforcement action <br />will be taken. This straw dike traps a great deal of sediment and must be kept in operating <br />condition at all times in order to prevent sediments and coal fines from entering Hubbard <br />Creek. <br />The drainage ditch leading from the pvc pipe to sediment pond k2 has breached in <br />one area and needs to be reestablished as soon as possible. This ditch has breached <br />repeatedly in the past and presents a continual problem to providing adequate drainage <br />control for the portal bench area. Rocks and boulders sloughing off of the unstable bench <br />fill slope directly above the ditch frequently wind up in the ditch channel, thereby <br />blocking the ditch and preventing runoff from reaching sediment pond /{2. It is essential <br />that this ditch be maintained on a regular basis, as it is an important component of the <br />sediment control system. A regular maintenance schedule for this ditch and other aspects <br />of the sediment control system which present recurring maintenance problems at the mine <br />site must be developed by the operator. For these types of problems which occur on a <br />regular basis, the Division's monthly inspection interval is simply not frequent enough <br />to catch these recurring problems as soon as they arise, and the burden of maintaining <br />the system as designed must rest with the operator. In this way, the Division will be <br />assured that these "problem areas" are dealt with as soon as possible, thereby preventing <br />contributions of sediments into Hubbard Creek and other undisturbed areas. <br />
