A site inspection was conducted in response to a complaint received froco a new landowner, <br />Mr. Joseph R. O'Brien of the Red Creek Ranch at Hatchet. Mr. O'Brien'e concern ie that there <br />appears to be significant mining disturbance outside the 9.9 acre permit area. <br />2. The site inspection was conducted in the presence of Mr. Wayne E. Seifert of BMI-France, <br />Canon City, Colorado. The Siloam Pit is permitted for 9.9 acres of disturbance. Commodities <br />to be mined include rip rap, road metal, ballast, decorative rock, building atone, and clay. <br />The poet-mining land use is designated ae rangeland. The operator has posted a financial <br />warranty of 536,500. <br />3. This inspector estimated a total disturbance of at least 16.5 acres. Approximately 8.5 <br />acres were drastically disturbed and will require extensive backfilling and grading to <br />achieve the desired poet-mining topography. There were approximately 8.0 acres of moderate <br />disturbance that will require revegetation and possibly reapplication of topsoil. The 8.0 <br />acres of moderate disturbance consist of storage yards for decorative rock recently excavated <br />from the pit. <br />4. Although the permit boundary markers were not visible during the inspection, it appears <br />that the major or drastic disturbance may occur within the 9.9 acre permit boundary. Mr. <br />Seifert was informed of the concern for adequate boundary markers and was requested to <br />install adequate markers in conformance with Rule 3.1.12 (see attached copy). See page 3 for <br />details. <br />5. This inspector estimates that a significant number of acres have been disturbed outside <br />the permit boundary. Therefore, the Division requests the operator to conduct an accurate <br />survey of all disturbance at the Siloam Pit and submit the results by January 22, 1997. The <br />survey should delineate the 9.9 acre permit boundary, the current disturbed area boundary and <br />total acreage. Please see Page 3 for details. <br />Mr. Seifert indicated that a sub-contractor Mr. Ferd A. Mueller of Siloam Stone is <br />responsible for the recent 2.5 acres of drastic disturbance on the eastern edge of the pit <br />as well as the moderate disturbance outside the permit boundary. Mr. Seifert indicated that <br />BMI-France has not mined in the Siloam Pit since 1989. <br />6. The Division will send Reason To Believe letters to both the operator as well ae Mr. <br />Mueller for either mining without a permit or disturbing significant acreage outside the <br />permit boundary. The Division will schedule this matter as a Formal Public Hearing before <br />the Colorado Hine Land Reclamation Board at the February 26-27, 1997 Board Meeting in Denver. <br />If both parties, however, decide to waive their right to a hearing within 30 days of issuance <br />of the Reason To Believe letter then the Division will schedule the matter at the January 22- <br />23, 1997 Board Meeting. Both parties will need to submit a request in writing by 5:00 P.M., <br />January 17, 1997 in order to appear at the January Board Meeting. <br />7.
