However, the operator has committed to procuring <br />sufficient water necessary to support mining operations. <br />Water truck and portable water tank were located adjacent to the processing equipment. Water <br />was observed dripping from both of the water containers. Operator indicated that approximately <br />6000 gallons/day water are applied to crushing equipment and roads for dust abatement. <br />Therefore, the operator appears to be in compliance with DMG permit conditions regarding water <br />source necessary to support mining operations. <br />Deviation of Mining/Reclamation Plan Timetable -Pursuant to Rule 6.4.4(e1, the permit provides <br />an approximate timetable to describe the mining operation. The timetable includes a detailed <br />description of the proposed size, location, sequence and time period for each of the mining phases, <br />as required by Rule 6.4.41e)11), lii) and liii). However, Rule 6.4.4(e) clearly states that the timetable <br />and description are approximations and that the operator shall p~ be required to meet specific <br />dates for initiation, or completion of mining in a phase as described within the timetable. <br />The permit indicates that the phased operation will progress from the south to the north, in 150' <br />wide panels with contemporaneous reclamation. However, due to archaeological site 5MT2020, <br />located in the western portions of phases 1-4, the operation cannot progress as indicated in the <br />original plan. Please find attached, copy of the Pre-Mining Map, Exhibit C, submitted 9/30/97, <br />modified to show the approximate location of affected and reclaimed lands observed during the <br />inspection. <br />Please update the timetable and description of the Mining/Reclamation Plan, to reflect modifications <br />to the operation necessitated by the location of archaeological site 5MT2020. Please submit such <br />modification through the Technical Revision process, described under Rule 1.9.1, with the $150 <br />application fee required by C.R.S. 34-32.5-125(1)(a)(VII-. <br />5MT2020 -Archaeological site, 5MT2020, was delineated by wire fence. Evidence of mining <br />operations within the delineated site was not observed. <br />Notice of Insufficient Financial Warranty -DMG holds $17,232 financial warranty. DMG 12/8197 <br />reclamation cost estimation, totaling $17,232, was based upon a phased mine plan with <br />contemporaneous reclamation, maximum unreclaimed disturbance limited to 9 acres. However, <br />during the inspection, DMG observed that operations have resulted in approximately 13.2 acres <br />disturbed, with approximately 3.7 acres partially reclaimed. <br />Based upon observations made during the inspection and recorded within this inspection report, <br />DMG has reviewed the cost of reclamation. DMG had determined that the cost of reclamation, per <br />
