<br />Riverside Reservoir and Land Company <br />Riverside Irrigation District <br />Farmers State Bank of Brush <br />Case No. 90-CW-189 <br />Page 6 <br />G. Headley Recharge Pond No. 5: 2.1 acre-feet, <br />absolute; and 122.9 acre-feet, conditional. <br />H. Headley Recharge Pond No. 6: 3.5 acre-feet, <br />absolute; and 56.5 acre-feet, conditional. <br />The right to store water in Riverside Reservoir and Wildcat <br />Reservoir is subject to the terms and conditions of paragraph <br />28 below. The right is claimed to fill and refill the above <br />storage structures continuously when the fill right described in <br />Section B above is in priority. The rate of diversion claimed <br />for filling each of the above storage structures is 120 cfs for <br />Riverside Reservoir and Wildcat Reservoir and 40 cfs for each of <br />the Recharge Ponds; provided however, that the total filling rate <br />hereunder for all of the above storage structures shall not <br />exceed 120 cfs at any given time. <br />17. Ose: <br />Water temporarily stored in Riverside Reservoir or Wildcat <br />Reservoir hereunder may be released and delivered by the River- <br />side Canal System for placement into the Recharge Ponds. Water <br />placed into the Recharge Ponds will be used for wildlife habitat, <br />recreation, and aesthetic purposes; or used for recharge of the <br />alluvial aquifer and augmentation purposes. water recharged <br />pursuant to this decree will be divided between co-applicants, <br />with 508 belonging to Riverside Reservoir and Land Company and <br />Riverside Irrigation District and 508 belonging to Farmers State <br />Bank of Brush. The use of the 508 of the Recharge Credits <br />belonging to Riverside Reservoir and Land Company and Riverside <br />Irrigation District will be used to replace depletions resulting <br />from out-of-priority diversions from existing wells described in <br />Exhibit B attached hereto and/or wells to be constructed pursuant <br />to additional plans for augmentation or substitute supply plans <br />by Riverside Reservoir and Land Company and/or Riverside Irriga- <br />tion District. Nothing herein shall constitute either approval <br />or disapproval by this Court or of any party hereto, including <br />the State and Division Engineers, of any such additional plan for <br />augmentation. Nor shall this decree prevent any person, includ- <br />ing the parties hereto from fully participating as objectors in <br />proceedings before this Court involving such plans. The 508 of <br />the Recharge Credits belonging to the Farmers State Bank of Brush <br />will be used as the augmentation source in the Plan for Augmenta- <br />tion described in Section D, below. <br />18.
