<br />Riverside Reservoir and Land Company <br />Riverside Irrigation District <br />Farmers State Bank of Brush <br />Case No. 90-CW-189 <br />Page 21 <br /> <br />51. The application for surface water right described in <br />Section B above, and the application for water storage rights <br />described in Section C above are hereby granted and the water <br />rights and conditional water rights described therein are hereby <br />decreed. <br />52. The plan for augmentation described in Section D above <br />is hereby approved, subject to the terms and conditions provided <br />for herein. The State Engineer; the Division Engineer for Water <br />Division No. 1, and other water administration officials subject <br />to their supervision are ordered to administer this plan for <br />augmentation in accordance with this decree and in accordance <br />with the priorities awarded herein. <br />53. Well permits for any of the augmented wells not having <br />existing permits shall be issued by the office of the State <br />Engineer, as necessary and upon Applicants' proper application <br />therefor. Said permits shall contain terms and conditions no <br />more restrictivE than those contained in this decree. <br />54. An application for finding of reasonable diligence for <br />the conditional water rights decreed herein shall be filed in <br />of 1998 and as required by statute or decree there- <br />after so long as Applicants desire to maintain such conditional <br />water rights, or until a determination has been made that such <br />water rights have been made absolute. <br />55. The Court retains jurisdiction of the augmentation plan <br />decreed herein as set forth in paragraph 44, above. <br />56. Pursuant to C.R.S. §37-92-305(8), the State Engineer <br />shall curtail any out-of-priority diversion the depletions from <br />which are not so replaced as to prevent injury to vested water <br />rights as provided in this Decree. In the event that there is <br />ever insufficient augmentation water to so replace such deple- <br />tions associated with the gravel pits as described herein, the <br />Bank or its successor(s)-in-interest shall have the continuing <br />obligation to acquire additional augmentation water from sources <br />acceptable to the Division Engineer to so replace such depletions <br />in a manner acceptable to the Division Engineer. <br />57. This judgment and decree shall be filed with the Water <br />Clerk and a copy filed with the State Engineer and Division <br />Engineer. <br />
