III. COMMENTS -COMPLIANCE <br />Terror Creek C-81-059 <br />Pg 1/1 14 Sept 04 ~~ <br />Below ore comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Terror Creek Loadout conducted by Jim Stark of <br />CDMG. Jim Kiger of Terror Creek Company accompanied me on the inspection. <br />The site is a loadout only and was loading train cars at the time of the inspection. The <br />weather was warm and sunny and the ground was dry. <br />Signs and Markers: The mine Id sign was in place and contained all of the necessary <br />information. The permit boundary and disturbed area markers were in place. <br />Roads: -The haul road/mine entrance road is a paved road. The road was well <br />maintained and in good condition. <br />-The light-use road along the railroad tracks was stable and in good condition at the <br />time of the inspection. <br />Hydrologic Balance: -All of the ditches were clean and appeared to be stable at <br />the time of the inspection. The sides of the ditches were well vegetated and there <br />were no erosional problems noted. <br />-The sediment pond contained water approximately three feet below the discharge <br />pipe. The pond embankment was well vegetated and stable of the time of the <br />inspection, There were no erosional problems noted at the time of the inspection. <br />-The sump was dry at the time of the inspection. This is an incised pond. The side <br />slopes were well vegetated and stable at the time of the inspection. There were no <br />erosional problems noted on the side slopes of the sump at the time of the <br />inspection, <br />-The containment berms around the diesel storage tanks were in good condition. <br />Processing Waste: There was a large pile of rock and coaly waste near the diesel <br />storage tanks. The pile contained approximately 100 cubic yards of material. <br />Topsoil: The topsoil stockpile was stable at the time of the inspection. The south side <br />of the pile has been revegetated and matted. There were no erosional problems <br />noted on the pile. The topsoil sign was in place on the pile at the time of the <br />inspection. <br />Air Resource Protection: -The operator was watering the yard area at the time of the <br />inspection. <br />-The operator was loading train cars at the time of the inspection and there was not <br />a problem with fugitive dust. <br />
