III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Jce Dudash of the Colorado DRMS. No one represented the operator. <br />Run-of--Mine Stockpile <br />This area was covered in snow, There was a little snow melt in the sediment pond. There was no ponded water <br />on top of the pile. The road was snow covered but passable. The mine ID sign was up and surface disturbance <br />markers were up around the site. The collection ditches were covered in snow. <br />West Mine <br />The west mine was mostly covered in snow, although some bare areas were beginning to show. The road to the <br />site was snow covered but passable. The road to the reclaimed fan site was for snowmobile only. There were no <br />indications of slope instability or erosional problems with the backfill. The two sediment ponds were snow <br />covered but did not appear to have any water of any consequence in them. The mine ID sign was up. <br />Well Field <br />The site was covered in snow, except for the graded entrance road, which was muddy but passable. The mine ID <br />sign, topsoil stockpile sign and surface disturbance markers were up. There were no problems with the facilities. <br />Unit Train Loadout <br />No new reclamation work has been done at the loadout. All three entrances were open and each had a mine ID <br />sign. The sediment pond was dry. Collection and diversion ditches were functional. However, the berms should <br />be beefed up on the east side of the loadout. Also, the diversion berm going east from the east entrance also <br />needs to be beefed up. The central diversion system of culvers and ditches was functioning properly, <br />The reclaimed west end of the spur track was in very good condition. The operator has done a real nice job here. <br />However, the silt fence could use some repair in spots. <br />Highwav Coal Stockpile <br />The coal stockpile in this area has been removed and the area covered with dirt. The excess dirt from the <br />reclamation of the spur line is being temporarily stored here. The sediment pond had very little water in it. The <br />cut slope was stable. The mine ID sign and surface disturbance markers were up. <br />East Mine <br />The entrance gate was locked and the mine ID sign was up on it. Surface disturbance markers were up around <br />the site. No reclamation has occurred since the last inspection. The haul and access roads were partially snow <br />covered with a few rocks on them, but both roads were passable. Cut and fill slopes appeared to be stable. The <br />four bin wall ponds and west ridge waste pile pond were covered in snow, as were the culverts and ditches. <br />c:/word bowie 1 /insp0307 <br />
